Coach-Client Relationship
The purpose of the coaching sessions is to help you achieve your defined goals. The services you will receive includes: providing strategies, tips, tools and techniques; identifying action plans; providing accountability and structure; encouraging you; and asking process-provoking questions. Any "Do-This For-Me" services are not included in this coaching package (See website for more information.)

My coaching process includes allowing the Holy Spirit to be the central point of our coaching relationship, not in a religious way but in a relationship way. I believe that what we do has to begin with hearing the voice of God and following HIS instructions. The sessions do include prayer. Recording of Session at no additional charge, each session will be recorded and submitted to client within 72 hours.
A. Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
B. Client further acknowledges that he/she may terminate or discontinue the coaching relationship at any time, however there are no refunds.
C. Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client's responsibility.
D. Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client's exclusive responsibility
to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.
E. The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.

Provider shall deliver Services to Client at the following location(s): The parties agree to engage in a custom Coaching Program through Zoom meetings for 12 Weeks. The Resilient Business Bootcamp is an in person event with virtual options available.

Intellectual Property
Copyright Ownership. In the event that any copyrighted work(s) are created as a result of the Services provided by Above Only Leadership/ Dr. Tuby Akinlosotu in accordance with this Agreement, Above Only Leadership/ Dr. Tuby Akinlosotu owns all copyrights in any and all work(s) it creates or produces pursuant to federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling this Agreement, are expressly and solely owned by Above Only Leadership/ Dr. Tuby Akinlosotu and may be used in the reasonable course of Above Only Leadership/ Dr. Tuby Akinlosotu's coaching practice.
Permitted Uses of Product(s) Provider grants to Client a non-exclusive license of product(s) produced with and for Client for personal use only so long as Client provides Provider with attribution each time Client uses Provider's property. Personal use includes, but is not limited to, use within the following contexts:
1. In photos on Client's personal social media pages or profiles; or
2. In personal creations, such as a scrapbook or personal gift; or
3. In personal communications, such as a family newsletter or email or holiday card.

Video and Photo Release:
I hereby grant the releasee permission to use photographs in any of the following:
-Web based productions
-Print Advertisements
-Social Media Posts/ Reels
-Organizational Bulletins
1. Videos and Photos of me participating in programs and masterclasses
2. Video testimonials
3. Video clips and photos of me talking and/ or screenshots of my messages in online programs or workshops
I hereby affirm that I am of legal age and agree that such release to the releasee does not constitute any form of compensation, including royalties arising from the videos and/ or photographs to my benefit.
I understand and agree that videos and/ or photographs in the possession of the releasee shall become the property of the releasee. The use and publication of the photographs however, shall conform to my rights as a subject of said photographs.
I hereby waive my right to inspect of approve the videos and/ or photographs by which my likeness appears.
I hereby hold harmless, release, and forever discharge the Dr, Tuby Akinlosotu/ Above Only Leadership/ Help Her Thrive from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
Impossibility
Force Majeure. Notwithstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:
1. A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or
2. War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not);
3. Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.
Failure to Perform Services. In the event Provider cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:

1.Immediately give Notice to Client via the Notice provisions detailed in this Agreement; and
2. Issue a refund or credit based on a reasonably accurate percentage of Services rendered; and
3. Excuse Client of any further performance and/or payment obligations in this Agreement.
Appropriate Conduct/ Safe Working Environment.
Project:
The Client(s) expressly agree(s) to take best efforts to provide [Provider] and Provider's staff with safe and appropriate working conditions. In the event of circumstances deemed by either [Provider] or a bystander to present a threat or implied threat of injury or harm to [Provider] staff or equipment, the [Provider] reserves the right to cancel all services remaining under this Agreement and leave if performing services on-location. At the [Provider]'s discretion, the [Provider] may enact a three-strike policy. After the first offense, the [Provider] will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), [Provider] shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the project. If the behavior occurs a third time, the [Provider] will immediately leave the project. If the [Provider] leaves the project early due to any offending behavior, the Client(s) expressly agree to relieve and hold [Provider] harmless as a result of incomplete project coverage, or for a lapse in the quality of the [Provider's] work, and the Client(s) shall be responsible for payment in full.
Non Project:
The Client(s) expressly agree(s) to take best efforts to provide [Provider] and Provider's staff with a safe and appropriate professional relationship. In the event of circumstances deemed to present a threat or implied threat of injury or unprofessional, harassing language or behavior to to Dr. Tuby Akinlosotu or staff, Dr. Tuby Akinlosotu will make reasonable efforts to notify the Client(s). If the Client(s) is/are able to respond to the threatening situation in a reason.
